Ready for your own path, not your spouse's?
F-1 → OPT → your own H-1B.
H-4 EAD rules change. F-1 creates a path to work authorization that doesn't depend on your spouse's status — and to your own H-1B after OPT.
Three scenarios we see most often.
Policy changes have repeatedly restricted H-4 EAD eligibility. F-1 + OPT is a more durable work-auth path.
You've been in the U.S. for years as H-4 with limited work. A master's rebuilds the résumé and signals reinvestment to future employers.
Your status should not depend on someone else's stability. F-1 is independent.
A typical H-4 → F-1 case, week by week.
- Week 0
Status Review. We discuss your goals — work authorization, career restart, financial plan — and shortlist programs.
- Weeks 1–4
Applications to 3–5 programs. For the H-4 profile, we emphasize programs with strong employment outcomes.
- Weeks 4–5
I-539 filed. Your H-1B spouse's status supports your financials; we package the affidavit of support properly.
- Weeks 5–12
USCIS adjudicates. On approval, start coursework full-time, plan for semester-2 CPT or year-1 OPT timing.
Things that trip up H-4 holders.
Career gap on résumé
Most H-4 clients have years-long gaps. We address this in the SOP by framing the gap as deliberate re-skilling, not abandonment.
Financial documentation
If finances come from your H-1B spouse, we use an I-134 affidavit plus bank statements plus employment verification — all three.
Dependents
If you have children on H-4, they can remain on H-4 even when you switch to F-1 — or switch to F-2 as F-1 dependents.
